When I used my judgment to not move over and instead slow down, the officer wrote me a misdemeanor. He testified in court that he did not feel threatened and was done writing his previous ticket and safely tucked in his car when I passed him at a reduced 50mph on a 65mph M-14 freeway. It gets better! The public prosecutor decided to press for a jury trial after the first non-jury trial where the officer did not even show up! After a hung jury, the public prosecutor is pressing for a second jury trial. All this, when he had not even watched the video for 6 months!!! Great use of our tax dollars, wouldn't you agree? They can keep pressing a criminal charge as long as they want, though not once have they suggested defensive driving. They even mocked my American Red Cross Emergency Vehicle driving record! I respect officers and the justice system, (I have written letters of apology and spoken to the Mayor, John Hieftje) but bad apples need to be exposed and let the public decide. I am defending myself, have no prior criminal record, no points on my license and cannot afford to pay $1500 to a lawyer to settle. With help from the jury, I'll ensure the city is reminded that Americans don't settle or negotiate with people that threaten of consequences. No matter what you think, pls. look into the case before you judge this. The truth is, 1. the city has not presented any video of the three seconds of traffic in the rear of the officer's vehicle to show conclusively that I could have moved over (their video starts the time I pass the stationary emergency vehicle from a front-mounted camera) 2. No one was hurt or injured or even threatened. My questions are: 1. How does that give them the right to try me in a criminal case? 2. Should they press charges after 2 trials and 8 months just because they can use our tax dollars infinitely? 3. Shouldn't they look into safety (me paying $300 does not make the city safer) 4. The Officer was done with his previous stop, still flashing his emergency lights (abuse of power) and drove nearly 100mph on a 65mph freeway without his emergency lights on while trying to pull me over (he started 20 seconds after I had passed him) - going by this standard, I used way more "care and caution" 5. Officer did not pull several other drivers that did not move over when they could have, instead pulled me over at a fork on a exit ramp and made me sit there with traffic buzzing past on both sides! These people deserve what they get, a big fat ticket to remind them. Ive even given the person on my original stop a break and given him a verbal warning and went after the moron that just missed hitting me and stopped them. Guess what they said. Hmmmm. " I didnt see you". What a load of @##%, The LED lights on my cruiser can be seen from miles away. As far as im concerned you act like an idiot, lie to my face you get treated like an idiot. Act like a lady or gentleman, you get treated as such. The big issue I have is that signs are posted regularly along interstate but very few know the consequences of not moving over AND slowing down. Construction zones tell the penalty. Signs for this should do the same since the penalty is so extreme. It also doesn't clarify whether emergency lights have to be on or not. However, there are so many things going on during a traffic stop some things just take priority and constantly looking behind you is often not an option, at least not as much as one would like. Many subcontractors cut corners and leave their worker vulnerable. I've seen this sign at state border crossings to notify drivers. They are very explicit to move to the left or else. On these same highways, this law, if followed to the letter, can have potential to cause harm instead of preventing it. For example, with a divided highway, what if the vehicle is stopped on the left shoulder? What of the maintenance crew cutting grass?
