When I was 18 (1961) it was legal to drink 3.2% beer and drive in Kansas.

I almost got into trouble when I moved to Calif. 

Fortunately my friends told me it was not permitted and I didn&#039;t do it anymore.</description>

		<description>Even knowing I would easily pass a blood alcohol test because I don&#039;t drink  I would never willingly comply with a blood draw by law enforcement on the roadside.

This judge was arrested for driving 92 mph in a 65, she had an open container of beer between her knees, and she was DUI.  The DUI was dropped, but I&#039;m not sure about the speeding.

Worse, she refused a breathalyzer, which should have brought an AUTOMATIC suspension.  But no-- the DUI was thrown out.

I&#039;m a phlebotomist and I was not allowed to draw ROUTINE blood in a clinical/hospital setting unsupervised until I had made 100 successful single-try sticks.  If I didn&#039;t get the blood on the first try, my proctor had two tries.  If the proctor didn&#039;t get it then, another experienced tech or nurse was to try.  If that failed after 2 attempts, then a physician was to try.  The physician had three tries-- after that, it was marked as &quot;unsuccessful&quot;.

In the case of DUI sticks in our state, the cop has as many tries as he wants to get the blood.  After a few pokes, the needles become dull and cause more pain and trauma to the patient.  The risk of damage to the vein increases.  This is especially true if the person has certain medical conditions.  And yes, the cops may do just what you say-- &quot;flashlight in one hand, needle in the other&quot; out in the open, at roadside.

If the officer doesn&#039;t get the blood, he can document it as a refusal-to-test, resulting in the driver&#039;s license being taken away for a year, just as if the driver refused to blow into the breathalyzer-- even if the person let the &quot;phlebotomist-cop&quot; stick him repeatedly.  Not all veins are drawable-- sometimes they collapse, roll away, or blow (rupture).  Some people have bleeding disorders that can cause uncontrolled bleeding and risk to the patient.

Other people have medical conditions that require special techniques or equipment such as a butterfly catheter in order to access the vein.  Police are not taught these techniques.  So, in the course of violating one&#039;s Fouth Amendment rights, the police now have impunity to inflict pain and potential bodily harm on the public.

Leave the blood draws to the medical professionals.  Phlebotomists don&#039;t write speeding tickets.  Cops shouldn&#039;t be drawing blood.</description>

		<description>The big problem with Dui is,  it was a very excepted social norm not that long ago.We all watched are moms and dads drive merrily down the road with a drink in thier hand in The sixties and seventies.Most were pillars of the community.Even our drunkest uncle only spent a night in jail to sleep it off.Then in the eighties,idiot lawmkers expected every one to change thier way&#039;s immediatly.All of the sudden, people were going to jail for some thing they had been doing since they were eighteen.Idiot lawmaker&#039;s didn&#039;t stop long enough to realize that people have been drinking and driving in this country with not much consequence for Eighty plus freiking years.Lawmakers either need to have prohibition re estlablished, or consider dui a problem of thier own making.You can&#039;t stop a social norm and not expect it to be mess.It&#039;s now 2009 and the problem is still just as bad,wake up America!!</description>
